PMHA By-Laws

PARRSBORO MINOR HOCKEY

GUIDELINES AND BY-LAWS 

 

Article 1:

Name - The Association shall be known as the Parrsboro Minor Hockey Association, hereinafter referred to as “PMHA”

Article 2:

Authority

2.1 - This organization is the governing body and has full and complete jurisdiction over all minor hockey as per boundaries outlined by the association.

2.2- This organization will be a member of the Nova Scotia Minor Hockey Council.

Article 3:

Aims and Objectives

1.         To promote an organized hockey program for all area youth as defined by the Canadian Minor Hockey Association.

 

1.1       Maintain an elected governing body to administer the minor hockey program.

1.2       Follow provincial and Canadian guidelines.

1.3       Provide the timetable for each level.

1.4       Ensure certification of coaches and refs at all levels of play.

 

2.         Liaise with other Minor Hockey Associations to foster sportsmanship and competitive hockey for all.

 

2.1       Communicate with neighboring associations on a regular basis.

2.2       Explore opportunities to work in partnership with other Associations to enhance player development and sportsmanship.

 

3.         Promote and encourage respect for all participants in minor hockey.

 

3.1       Maintain a Code of Conduct for players, coaches, parents and spectators.

3.2       Liaise regularly with the Referee in Chief to address concerns.

 

 

 

4.         Provide a safe environment for participation of players and officials.

 

4.1       Participate in the STOP program.

4.2       Enforce use of regulation equipment for all on-ice participants.

4.3       Abide by Hockey N.S. Guidelines.

4.4       Enforce Code of Conduct for players, coaches and spectators.

 

5.         Encourage active, equal participation of all youth to the best of their ability in a positive atmosphere.

 

5.1       Support the Fair Play program.

5.2       Promote and enforce the Code of Conduct for parents, referees, players and coaches.

5.3       Provide financial direction and assistance as necessary.

 

6.         Promote and maintain a drug-free program.

 

6.1       Maintain a zero tolerance policy on drug/alcohol use for all participants of PMHA.

6.2       Provide information to coaches and players on perils of drug use.

Article 4:

Membership

Upon paid registration parents or legal guardians will be members of the Association. Members of the Association will also include Head Coaches and Executive Members.

There is to be only one registration completed per child. No one child can appear on two rosters. Girls must either play for a co-ed team or an all girls team; they will not permitted to play both, even if the co-ed team registers with HNS as “house”.

Article 5:

            Association Boundaries

The Association shall be composed of Parrsboro and Area. The area shall be described as from the Colchester/Cumberland county line on Hwy. 2 in a straight line to Southampton and then from Southampton in a straight line to Joggins. The area will also include Hwy. 302 from Southampton to Hoeg’s Lumber Mill and Hwy. 2 from Southampton to the old Brown’s Lumber Mill.

 

 

ByLaw 1

Parrsboro Minor Hockey shall have an executive board elected biannually at a general meeting. One executive member per household, for voting purposes.

The executive shall consist of

            President

            Vice-President

            Past President                non voting, advisory only, one year term

            Secretary

            Treasurer/Registrar

            Hockey Development

            League Coordinator

            Fundraising Chair

            Referee in Chief.

            Female Coordinator

All positions will be elected for a term not to exceed two years unless re-elected at a general meeting.

ByLaw 2

Duties of Officers

President:

1)      Preside over all meetings of the Association.

2)      Shall be a non-voting member of PMHA, except in a tie situation.

3)      Be one of the three authorized signing officers and may co-sign cheques of authorized accounts and bills.

4)      Shall be responsible for supervision of all Parrsboro Minor Hockey Association activities and sign all official documents.

5)      Shall be responsible to ensure that each executive member fulfills their responsibilities as outlined by the by-laws.

6)      Shall act as a member of the appeals/protests and discipline committee.

Vice-President:

 Shall assist the President in their duties and shall perform his/her duty in his/her absence, when called upon to do so

1)      Shall be a voting member of PMHA and be actively involved in the appeals/protest and discipline committee.

2)      Shall be a signing officer.

3)      Chairperson of the annual PMHA tournament

4)      Any other duties as assigned by the President.

Past President

1.      Attend executive meetings.

2.      Act in an advisory position for incoming members.

3.      Be a nonvoting position.

Secretary:

1)            Shall keep an accurate account of all proceedings of the Association.

2)            Shall be a voting member of PMHA.

3)      Shall notify all officers of the time and place of association meetings and will prepare an agenda for all meetings.

4)      Shall provide any records of minutes from meetings as requested by the President.

5)            Shall be responsible for correspondence as directed by the President.

6)            Any other duties as assigned by the President.

Treasurer/Registrar:

1)      Shall keep a true and accurate account of all monies received and disbursed by PMHA, and shall, when directed by the President, make all disbursements of PMHA.

2)      Shall be a voting member of PMHA.

3)      Shall prepare a monthly financial statement to be presented at a general monthly meeting.

4)      Shall present at each annual meeting, a report of the year's financial operations.

5)      Shall be a signing officer.

6)      Shall keep an accurate account of all paid registration and ensure that a record is kept of all registrations and prepare a report for any registration issues and reporting of same to Hockey NS

7)      Shall prepare a budget for the upcoming hockey year.

8)      Any other duties as assigned by the President.

Female Coordinator

1)      Shall be a voting member of PMHA.

2)      Liaison between Female Regional Director, along with PMHA President.

3)      To assist in coordinating games and/or League affiliation as requested by Female Coaches.

4)      Any other duties as assigned by the President.

 

 

 

League Coordinator

1)      Shall be a voting position of PMHA.

2)      Will be responsible for all ice scheduling.

3)      Liaison between coaches, Lion’s representative, web-site manager, Treasurer and RIC to schedule ice.

4)      Provide monthly report to Treasure on ice used by individual teams for billing purposes.

5)      Liaison between Regional Director, only in the absence of the PMHA President or as directed by the President of PMHA.

6)      Any other duties as assigned by the President.

Hockey Development

1)      Shall be a voting position of PMHA.

2)      To provide coaches with dates of upcoming courses.

3)      Ensure certification of coaches and refs at all levels of play.

4)      Provide coaches meeting at start of season

5)      Be a member of the Appeals, Protest and Discipline committee.

6)      To coordinate all events for Hockey Development weekend.

7)      To promote Hockey Development with all teams as much as possible.

8)      To provide a monthly report to PMHA Executive.

9)      Any other duties as assigned by the President.

Fund Raising Chairperson:

1)              Shall be responsible for arranging fund raising events for PMHA.

2)              Shall generate funding by means approved by the Executive.

3)              Shall prepare a monthly report to be presented at monthly general meeting or at request of the President.

4)              Any other duties as assigned by the President.

5)              In conjunction with the fundraising committee, grant fund raising activities for PMHA teams and receipt funds from same.

6)              Shall be a voting member of PMHA.

Referee-in-Chief:

1)      Shall be appointed by the executive.

2)      Shall be a non-voting member of PMHA.

3)      Shall be a registered referee through Hockey NS

4)      Shall be responsible for assigning on-ice officials for PMHA games as advised by the executive.

5)      Shall be responsible for the scheduling and organizing of referee clinics.

6)      Shall be responsible for advising the Executive for remuneration of officials.

7)      Shall be responsible for monitoring the performance of on-ice officials.

8)      Shall counsel officials on any shortcomings.

9)      Shall be responsible for keeping records of games officiated, and of payment of officials.

10) Shall prepare a monthly report for a general monthly meeting or at the request of the President.

11) Any other duties as assigned by the President.

Bylaw 3

Meeting Frequency

Executive meetings shall be held at least monthly during the hockey season, more often if deemed necessary by the President.

Special general meetings may be called at the discretion of the President at any time. A special meeting must be held if requested by majority of the Executive.

The Annual Meeting of the Association shall be held by the end of April to report on the past season activities and to conduct elections of officers, if necessary.

            One General Meeting shall be held at least once per year. It will be called by the President.

Bylaw 4

Voting Procedure:

Executive Meeting:

      1)      Each member is entitled to one vote.

      2)      Majority vote shall be the criterion for the decision on all resolutions. The President will have the final decision on all matters if a consensus is not possible.

General, Annual or Special Meeting

1)          Each household with a Paid registered participant will have one vote. The right to vote will be based on the date of the vote. Any votes taking place before December 31st will be based on last years registration plus any, newly paid registered participants of the current year. Votes taking place after December 31st will be based on the current year’s registration.

2)          No single person can cast more then one vote.

3)          The Parent designation on the registration card will be the participant to vote.

4)       Current members of the organization including head coaches, and executive members will be entitled to one vote upon good standing in the organization if there is not already a voting member per household.

5) At the discretion of the Executive decisions may be put forth to the general membership for vote. Items that must be voted on include any expenditure over $2,500.00, excluding ice fees or any By-Law amendments.

6)      Final decision will be made by votes or in the case of a tie, by the President.

7)      Voting for the election of Officers shall be by secret ballot.

8)      At the discretion of the Executive, votes on sensitive issues may be by secret ballot.

Bylaw 5

Notice of Meeting

            General- notice of meeting shall be advertised in the media.

            Annual- Minimum of two weeks notice must be advertised in the media

            Special General- Minimum of one week notice except when the Executive may deem necessary.

Bylaw 6

            Meeting Quorum

General Meeting- A quorum shall consist of at least 10 registered members.

            Annual Meeting- a quorum shall consist of at least 15 registered members.

Executive Meeting- A quorum shall be two thirds of the voting members of the Executive.

Bylaw 7

Removal from Office;

A member of the Executive may be removed from office before his or her term of office expires by:

1)            A simple majority vote of the Executive resulting from absenteeism a

consecutive meetings without reasonable cause.

2)                In other cases, the member of the Executive whose removal is proposed must

be provided with written notice at least two weeks in advance of a general meeting. This notice must contain the substance of the reasons for removal from position. An officer removed from office may appeal Hockey Council.

Resignation before end of Term;

Should an Executive member resign before completion of their term, the executive reserves the right to call an election or delegate the resigned position to another executive member until an election can be called.

Bylaw 8

Code of Discipline/ Complaints: see also Discipline Policy of PMHA

1)    Any complaint or discipline problem will be reported in writing and signed to the President.

2)   Appropriate discipline or complaint will be addressed by the Appeal Discipline Committee (president, vice president and Development Coordinator). The matter will be handled in accordance with Hockey Nova Scotia, Nova Scotia Minor Hockey Council, Canadian Hockey Association directives and PMHA policies.

3)            All decisions will be final and subject to no appeal.

                  4)   All complaints must remain confidential, unless the complainant asks for his or her name to be revealed.

Suspensions:

            A coach may suspend, for discipline, any player for up to one game or practice, suspensions of more than one game or practice must have the approval of the President and/or Executive.

Complaints:

If unable to solve the issue with the person involved then the following should be followed:

1)  Complaints about a coach, manager must be first addressed to the Executive.

2)  Fair play concerns should be directed to the Executive who will inform the President for appropriate action.

3)   Complaints about Referees and Linesmen will be directed to the Referee-in-Chief Any further follow up will be directed to the President for action. Note: This form of complaint is not meant for coaches or others who do not like the way a referee or linesman called a particular game, nor is it for questioning interpretations or judgment calls. Any serious concerns should be reported, in writing, to the PMHA Referee-in-Chief and a copy sent to the President.

Bylaw 9

Players Registration:

            No player may participate in the PMHA activities unless he/she is registered. A player is registered when:

1)   A completed registration form has been filed with the Registrar of the Association and Registration Fees have been paid, or arrangements made for payment in accordance with PMHA.

2)   Registration will be rescinded if fees are not paid in full by Dec. 15 of that season or alternate arrangements made with the registrar. 

3) Before a child can play the following year, registration fees from the last year the child registered must be paid in full.

Bylaw 10

Player Movement

1)   All player movement during the season must be made in accordance with NSMHC and CHA guidelines.

2)   No player male or female is allowed to practice or play in a game in an age group other then their own age group without Executive approval.

Guidelines of the CHA and NSHA will be followed in addition to:

Any player who wishes to play in an age category above their actual age must comply with the following requirements:

1)   The parents of the player must apply in writing to the Executive and include the following information:

a.   Players Age

b.   Players normal age category

c.   Players intended age category

d.   Reason for the application to be accepted
The player must agree to the move.

2)   The proposed age category must have space to allow the player to move (in accordance with CHA guidelines).

3)   The coach of the proposed age category must approve of the move.

4)   A review committee established by the Executive will evaluate the player during an actual game at the level the player should be based on their age. This evaluation will take into consideration, the players’ size, skating skills, puck handling skills, maturity, game abilities, attitude and respect they show to their teammates, coaches, and officials. There must be a clear majority based upon this evaluation that the player is capable of moving up to the proposed age category.

5)   If there is a question of liability, the decision will be based upon the best interests of the organization.

6)   Nova Scotia Minor Hockey must approve the application for this proposed move.

7)   The Executive will have the right to send the player back to their appropriate age level if the player is not capable of playing at the higher level or for any safety related concerns.

Bylaw 11

Coaching

1)   Coaches must apply in writing to PMHA each year by June 30th.

2)   Notices for coaching positions will be made public in the local media

3)   Persons interested in coaching must be willing to participate in the Fair Play program and take mandatory coaching clinics in accordance with CHA guidelines.

4)   All coaches must have a Criminal Record Check and Speak Out completed by the local police agency.

5)   All coached must submit to a Child Abuse Registry investigation and provide the Executive of the result. All inquires will remain confidential.

If two people apply for the same coaching position, the Executive will decide who is appointed to the position.

Any coach that violates CHA, NSHA, or PMHA Guidelines could result in discipline action or removal. The decision of the Executive will be final.

 

Bylaw 12

Fund-raising

1. All Teams will notify the fundraising committee on the approved form of any planned projects, tournaments, and fund-raising. Conditions will apply:

a) All Fund Raising must have the permission of PMHA.

b) Team revenue from any source will be deposited into the PMHA bank account to be held in trust for the team who generated the funds.

c) All tournaments will be registered with PMHA. A plan or budget must be submitted for Executive approval.

2. Sponsorship

a) Any team may seek out sponsorship with approval of PMHA Executive

b) Any equipment or player jersey purchases will become property of PMHA.

Bylaw 13

Regulations:

Minor Hockey Council

PMHA will adopt and abide by the provisions of Nova Scotia Minor Hockey Council

Bylaw 14

All decisions will be based upon the regulations adopted by Canadian Hockey Association, Hockey Nova Scotia, and PMHA. PMHA will adapt any Bylaws, Guidelines or Regulations set by these associations. Decisions will be final.

All teams, coaches, and league officials are representatives of the PMHA. Everyone must follow the rules and regulations set forth by PMHA, Hockey Nova Scotia and the Canadian Hockey Association. Any person, player, or team official violating these rules and regulations will be subject to disciplinary action.
